1. Scope
- These General Terms and Conditions (GTC) govern the legal relationship between RT360 AG, Klosbachstrasse 99, 8032 Zurich, and the customer.
- The customer expressly acknowledges that the GTC are subject to change and that they will be brought to their attention in an appropriate form. If the customer rejects these in writing within 30 calendar days, the old GTC shall continue to apply until the end of the service purchased by the customer. The customer cannot derive any rights from a change to the GTC. The current GTC can be viewed at any time at: https://www.rt360.ch/en/home/terms-conditions.
2. Contractual relationship
- The contractual relationship between the parties shall come into effect upon mutual signing of the registration form and approval of these GTC.
- Subscriptions are strictly personal and can only be transferred with the prior written consent of RT360. Multiple cards are transferable within their period of validity.
- The services to which the customer is entitled are based on the relevant information provided in the registration form.
3. Customer's duty to provide information
- The customer is responsible for checking with their doctor whether sessions with the AllCore 3600 device are suitable for them or pose a health risk. In addition, they must immediately notify RT360 of any subsequent changes in their state of health or any pregnancy.
- The customer must immediately notify RT360 of any changes to personal data relevant to the contract, such as address, telephone number, or email address.
4. Use
- The AllCore 3600 device is equipped with an app and cannot be used without access to this app. Upon conclusion of the contract, the customer receives individual app access instead of an ID card or a multiple-use card. This, together with the receipt for payment of the offer selected by the customer, serves as proof of identity. App access may only be passed on with the express consent of RT360.
- The offer can generally be used during opening hours. Due to the sometimes irregular opening hours and limited capacity, RT360 recommends that customers register in advance for a training/therapy session.
- The customer will be introduced to the AllCore 3600 device by an RT360 employee and supervised during the training/therapy session. For safety reasons, use of the device without supervision is not permitted.
- The customer is generally obliged to follow the instructions of RT360 and its employees.
5. Payment, time-out
- The customer must pay the price applicable to the offer they have chosen in a single payment upon conclusion of the contract. Deviations from this are possible in individual cases after prior agreement between the parties.
- This price applies regardless of the actual use of the offer, with no entitlement to a refund in the event of non-use.
6. Health insurance
- Upon request by the customer, RT360 will issue a confirmation of the purchased service for the attention of the health insurance company.
- It is the sole responsibility of the customer to clarify whether their health insurance company will contribute to the costs of the purchased service.
7. Liability
- The use of the RT360 offer, namely the use of the AllCore 3600 device, is at the customer's own risk and peril. The customer is solely responsible for taking out appropriate insurance. The customer is expressly advised to consult a doctor before using the RT360 offer to clarify whether this offer is suitable for them. RT360 accepts no liability for direct or indirect damage related to the setup of or participation in training/therapy sessions with the devices or resulting from failure to follow RT360's instructions, nor does the device manufacturer or importer accept any liability under product liability law. RT360 and/or its employees remain liable for intentional or grossly negligent behavior.
- RT360 is not liable for the loss of personal effects, valuables, money, clothing, etc. Any liability for items stored on the premises of RT360 is also excluded.
- The customer is liable for any damage caused by them to training/therapy equipment and must reimburse RT360 in full for the corresponding repair and/or replacement costs.
8. Operating/opening hours
- The customer is aware that the opening hours of RT360 are generally based on the needs of its customers and are therefore irregular. It is in the customer's interest to register in advance for a desired training/therapy session.
- RT360 reserves the right to temporarily or permanently close its business at any time. In the event of a temporary closure, the customer is entitled to an extension of the contractual service affected; in the event of a permanent closure, the customer is entitled to a pro-rata refund of the services not yet received.
- However, in the event of a cessation of operations due to force majeure (e.g., fire, epidemics, pandemics, government restrictions, strikes) and/or decrees or other actions by government authorities, there is no entitlement to a refund of prepaid contributions or to an extension of the contract term.
9. Contract interruption (time-out)
- Non-use of the contractual offer by the customer does not entitle them to a price reduction or a refund of the price paid.
- Even if the customer is temporarily prevented from using the offer, they are not entitled to a contract interruption (time-out). If there is a valid reason (illness, accident, pregnancy, military service, business trips abroad/further training, etc.), a time-out may be granted as a gesture of goodwill upon request by the customer and proof of the reason for the impediment; however, the customer has no corresponding claim.
10. Data protection
- RT360 guarantees compliance with the applicable legal data protection provisions, namely the Swiss Data Protection Act (DSG).
- The processing of personal data in connection with RT360's customer contracts is subject to RT360's privacy policy. This explains how RT360 handles personal data in connection with RT360 customer contracts, among other things, and contains, in particular, information on why personal data is processed, how it is shared within the Allcore Group, and what rights data subjects have with regard to their personal data. The privacy policy is available online, currently at https://www.rt360.ch/en/home/privacy-policy.
In addition, the customer acknowledges that they may be photographed or filmed during their participation in a session and that data relating to their sessions may be collected. They expressly agree that such data may be used for research/design purposes and reporting on the devices, and that photos and film recordings may be used for marketing purposes. By concluding the contract, the customer accepts the processing of their personal data in this manner.
11. Changes to the contractual agreements
Amendments and additions to the contractual agreements (including the General Terms and Conditions) must be made in writing and signed by the parties in order to be valid. This written form requirement also applies in particular to the cancellation of this provision. Mutual confirmations by email (without signature) satisfy this written form requirement in accordance with the intention of the parties.
12. Applicable law and place of jurisdiction
- These GTC and the customer contracts concluded under them are subject exclusively to Swiss substantive law, with the complete exclusion of the conflict of law rules of private international law and any relevant international agreements.
- The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the customer contracts is the registered office of RT360 AG (currently Zurich).
